ARTICLE 1 : ORDERS

To submit an order through our Internet site www.offrez-une-etoile.com, you must select a product, confirm your order and your method of payment, and accept these TCS. You will then receive an e-mail confirming your order.

ARTICLE 2 : PRICES

Prices are given in euros, all taxes included. The costs of shipping and handling are indicated below. Offrez-une-etoile.com reserves the right to change its prices at any time, but the products will be billed based on the prices in effect on the day of the order. Until the price has been paid in full, products remain the property of Offrez-une-etoile.com.

ARTICLE 3 : PRODUCT DESCRIPTIONS

By buying a Star Kit, you understand and accept that the naming of a star is only an innovative gift and that no title of ownership is associated with it. Global Stars makes no claim of official assignment of a star name that will be shared by the entire scientific community, inasmuch as this community uses only star numbers assigned by the International Astronomy Union. However, Global Stars recognises the names it has assigned to the stars through its registry.

ARTICLE 4 : PAYMENT

Payment is by PayPal (http://www.paypal.com), a leader in online secure payments. Payments are accepted by bank card, Visa, MasterCard, American Express, Carte Aurore, Cofinoga or Privilège, 4 Étoiles. The entire payment process is made secure using the latest-generation SSL Extended Validation certificates. At no time does Offrez-une-etoile.com record your bank information.

ARTICLE 5 : AVAILABILITY

Our product offers and prices are valid so long as they are visible on the Internet site, within the limits of available stocks. In the event that we are unable to fulfil your order, we will so inform you as quickly as possible by e-mail or regular mail; your order will be cancelled automatically and your money will be refunded immediately.

ARTICLE 6 : DELIVERY

Products are delivered to the delivery address you indicated when you registered or, as the case may be, when you submitted your order. Shipping times are on average 96 hours, the usual average time. For deliveries in Metropolitan France and abroad, deliveries are made by tracked letter; we pay shipping costs (if there is an error in the delivery address, costs relating to the re-sending of the package are borne by you). Offrez-une-etoile.com may not be held liable for a mistaken delivery if the address indicated by the customer is incorrect. In the event of a delay in shipping (greater than 7 business days), you will be entitled to cancel your order.

ARTICLE 7 : COMPLAINTS

You have seven (7) calendar days in which to return your order if you are not satisfied with it. You will pay the shipping costs both ways. The seven-day period begins with your receipt of the product. Returns are to be made to Offrez-une-etoile.com, 5 rue du Colonel Combes 75007 PARIS, in their original packaging, in good condition, and accompanied by a copy of the invoice.

Products returned incomplete, ruined, damaged or soiled by the customer will not be taken back or exchanged.

At the choice of Offez-une-etoile.com, the refund will be made either by cheque or by credit to your bank account.

ARTICLE 8 : RETURNS

If you wish to return your package, please follow this procedure.

1. Get a return code; you can request your return code by e-mail to the following address: contact@offrez-une-etoile.com. In your e-mail, please cite your order number and tell us the reason you are requesting a return.

2. Return your package. When you receive your return code, please return the contents of your order to us in its clean, original packaging, and by tracked Colissimo. On your package, write your return code so it is clearly visible. You will then inform us of your package number by e-mail.

3. Grounds for package refusal - The contents of the returned package are damaged.
-The package is incomplete.
-The return code is not indicated on the package.


ARTICLE 9 : PERSONAL INFORMATION

The information and data concerning you are needed in order to manage your order. In accordance with the Information Technology and Freedoms Act of 6 January 1978, you have a right to access, delete and correct personal data concerning you by contacting contact@offrez-une-etoile.com.

ARTICLE 10 : APPLICABLE LAW & DISPUTES

These TCS are subject to French law. In the event of a dispute, the courts of Paris (France) will be solely competent.

ARTICLE 11 : CONTRACT AMENDMENT

Any amendment to the contract is applicable only by written agreement between the merchant and the buyer.

ARTICLE 12 : CONTRACT DISSOLUTION

If the buyer does not fulfil the obligations deriving from the present contract and does not respond to a formal notice with a deadline of one week, the merchant is entitled to proceed to dissolve the contract without involving the courts. In this case, the buyer is liable for the damage suffered by the merchant. Payment obligations relating to activities already performed or to deliveries already made remain applicable. If, in the case of breach attributable to the buyer with regard to his obligations to the merchant, the latter resorts to (extra)judicial measures, the costs of these measures are borne by the buyer.

ARTICLE 13 : TRANSFER OF OWNERSHIP

Ownership of the goods is transferred to the buyer upon delivery. The merchant retains ownership over all goods delivered to the buyer until the latter has met all of his obligations under the present contract. Retention of title is also applicable to the receivables which the merchant may have vis-à-vis the buyer because of the buyer's breach of one or more of its obligations to the merchant. All costs associated with restitution of ownership are borne by the buyer.

The merchant retains industrial and intellectual property rights to the goods and services. The buyer becomes owner of the package delivered, without however being the owner of the star in question.

In the event of force majeure, undertakings relating to delivery or other commitments by the merchant are suspended. If the period during which, because of force majeure, the merchant is unable to meet its obligations is greater than two weeks, both parties are entitled to terminate the contract without legal intervention, without in this case establishing an obligation to pay compensation.

When the case of force majeure occurs, if the merchant has already responded in part to its undertakings or is able to respond only in part, it is entitled to separately invoice the part already delivered or the part deliverable, and the buyer is required to honour said invoice as if it were a separate contract.
